I am the non-custodial parent and I have physical custody of the minor child. What can I do?
If the custodial party is not aided, the custodial party can sign a closure letter. The Department of Child Support Services will continue to enforce the court order until it has been modified in court. You can speak to the Family Law Facilitator’s Office, located on the second floor, room 220 of the Main Courthouse at 800 11th Street in downtown Modesto. The Department of Child Support Services can modify the order but it will take approximately 6 months to complete.
I am the non-custodial parent and I am paying child support. However, the custodial party will not let me visit the child. What can I do?
If you have an order for visitation, seek the advice of a private attorney or other agencies such as the Child Abduction Unit, which may be able to help you with visitation issues. This office cannot address child custody and visitation issues. If you do not have an order for visitation, seek the advise of a private attorney, or you can speak to the Family Law Facilitator’s Office, located on the second floor, room 220 of the Main Courthouse at 800 11th Street in downtown Modesto, for assistance in obtaining an order for visitation.
The absent parent is not paying child support but wants to visit the child(ren). Can I keep him/her from visiting the child(ren)?
Child support and child visitation are two separate issues. If your court order reflects visitation, please refer to your order or seek legal advice.
