Who pays the deductible?
The Department of Child Support Services cannot force the non-custodial parent to pay the deductible. If the children are on Medi-Cal, the Department of Health Services may cover payment of the deductible. If the children are not on Medi-Cal, the custodial party is to pay the deductible. If the order states the non-custodial parent is to pay deductible, or that the deductible cost is to be shared 50/50, the custodial party may seek legal advice.
What if the custodial party takes the child to the doctor and there is no health insurance and the custodial party wants the non-custodial parent to pay for half?
Our office cannot enforce a percentage order. If the amount owed is reduced to a judgment with a specific dollar amount, the Department of Child Support Services can enforce the judgment.
What if the Department of Child Support Services has requested medical cards, ID cards, claim forms, etc., and the child gets hurt before they are received?
The Department of Child Support Services can request the insurance company provide a list of doctors, group number, effective date of coverage and insurance company number so that the custodial party can give the number to the doctor to verify coverage.
I am the non-custodial parent and my child(ren) are on Medi-Cal. Why do I have to provide health insurance for my child(ren)?
Medi-Cal is provided for those that qualify and do not have coverage. Federal law requires the parents to provide health insurance.
I am the non-custodial parent and if I have to provide insurance, I want to see my child.
